A shocking $1.2 million fine has been levied against a contractor for repeatedly ignoring safety rules, even after a worker tragically lost their life. In New Canaan, Connecticut, Sound Construction Inc., an earthwork contractor based in Easton, is facing a staggering fine exceeding $1.2 million. Federal safety inspectors from the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) uncovered that the company continued to expose its workers to life-threatening excavation hazards. This, despite a fatal workplace accident and years of warnings about their unsafe practices.
And this is the part most people miss: during a follow-up inspection at a Stamford site in June, OSHA found that Sound Construction willfully disregarded safety protocols, leaving workers vulnerable to cave-ins and other excavation dangers. This pattern of negligence isn’t new. Nearly a decade of safety violations has plagued the company, raising serious questions about their commitment to worker well-being.
In 2016, OSHA cited Sound Construction for three serious trench safety violations at a Trumbull worksite. Shockingly, just a few years later, in December 2023, a trench collapse at a New Canaan job site claimed the life of an employee. OSHA’s investigation revealed that the company had exposed five workers to hazardous conditions, failing to educate them about trenching risks and neglecting to provide cave-in protection for a 12-foot-deep trench.
Catherine Brescia, OSHA Area Director, stated bluntly, “Despite prior warnings, Sound Construction ignored trench safety protections, and that decision cost an employee their life.” She emphasized that employers must prioritize workplace safety to avoid such preventable tragedies that devastate families, friends, and colleagues.
The investigation also uncovered that the company failed to maintain a safe distance between an excavator and the trench’s edge and didn’t verify the location of underground utilities. OSHA issued citations for two willful and five serious violations, proposing penalties totaling $394,083. As part of a settlement, Sound Construction agreed to submit monthly lists of active worksites and allow random OSHA inspections.
However, during the June 12 follow-up inspection in Stamford, OSHA found that the company’s reckless behavior persisted. Inspectors identified seven willful and four serious violations related to excavation hazards. Shockingly, the company still hadn’t trained workers on unsafe trenching practices, provided adequate cave-in protection, or required daily excavation inspections. Additionally, they failed to follow proper trench shield installation standards and didn’t backfill shields to prevent hazardous movement.
These latest violations resulted in proposed penalties of $1,224,798—more than triple the amount from the fatal incident investigation.
